Privacy Policy

"Donde Estoy" allows you to check your device's location, save and manage places with photographs, remember where you parked, open directions, and find nearby places. Saved locations and photographs remain on your device. ElxDeveloper does not operate its own server to which the app uploads this content. Mapping services and the apps you choose for navigation or sharing may process the information needed to provide their services.

1. Data controller and contact details

Francisco Jose Gomez Gonzalez, trading as ElxDeveloper, is the developer of "Donde Estoy", also identified as "¿Donde Estoy Ahora?", and the data controller responsible for the processing described in this policy that falls within the developer's control. References to "ElxDeveloper" in this policy refer to Francisco Jose Gomez Gonzalez operating under that name.

This policy applies to the app. Any processing carried out by the website on which this policy is published must be explained in that website's privacy information.

2. Information used and its purposes

• Device location: with your permission, the app accesses your location when you open it to show where you are, allow you to save a position or parking location, and help you find nearby places. It may use precise coordinates if you have enabled Precise Location. It does not track your location in the background.
• Saved places: the app stores coordinates and the information you add when saving or editing a location, so that you can view and manage it and navigate to it later.
• Photographs: you can take a photograph or select an image from your photo library to associate with a location. The app uses the image you choose to add. Image files may contain metadata, depending on the file and the process used to save or share it.
• Shared content: when you use the sharing feature, the selected content is passed to the app and recipients you choose. It may include coordinates, map links, place information, and photographs.
• Support enquiries: if you send an email, ElxDeveloper receives your email address and the content you provide in order to respond. Please avoid attaching locations, photographs, or other personal information that is not necessary.

No user account is required. The app does not include advertising or third-party analytics or crash-reporting tools. ElxDeveloper does not sell your locations or photographs or use them for advertising, tracking across apps, or commercial profiling.

3. Permissions and your controls

iOS manages permission to access location and, where applicable, the camera and photographs. These resources are used for the features described above and in accordance with the permissions you grant.

You can deny or withdraw permissions in iOS Settings, under Privacy & Security or the app's settings. You can also change access to Precise Location where iOS provides that option. Withdrawing a permission may limit features that require it, but does not automatically delete places or images you have already saved.

Sharing content, selecting a photograph, and creating a backup are actions you initiate. The app does not automatically send your saved places to your contacts.

4. Storage and backups

Saved places and the photographs you add are stored locally on your device. The app does not provide its own synchronisation of that content with ElxDeveloper servers.

Features enabled through a one-time payment allow you to save more locations, access additional management options, and create a backup of locations on your device for later restoration.

Backups must be kept and protected separately. Deleting or editing a place in the app does not update or delete backups created previously. To delete that information as well, you must manage any backup files you retain.

Restoring data after uninstalling the app requires an accessible backup that has survived uninstallation. A backup kept only within the app's internal data may be deleted together with the app. The availability of a backup feature does not, by itself, guarantee recovery.

Device backups you configure in iOS or on a computer may depend on your system settings. If you choose to save or move a file to iCloud Drive or another provider, that service will process the file under its own privacy policy. This is separate from the local backup feature provided by the app.

5. Maps, searches, navigation, and external services

Apple MapKit and Apple services. The app uses MapKit for maps and place searches, including restaurants, pharmacies, and hospitals. These features may send Apple information needed to fulfil requests, such as the area being searched, search terms, and technical connection information. Apple's processing is explained in Apple Maps & Privacy and Apple's Privacy Policy.

Google Maps. Location-sharing features use Google Maps links so that locations can also be opened on non-Apple devices. A location link may contain the coordinates of a place. When the link is opened, the browser or relevant app sends the request to Google, which processes information in accordance with its Privacy Policy.

Navigation and sharing apps. If you open a place in a navigation app, it receives the information needed to locate the destination. If you share through WhatsApp, Messages, email, or another service, the provider and recipients receive the content you select. Someone who receives a location can learn where that place is and forward it to others. Review the content and recipients before sharing.

ElxDeveloper limits disclosures to those necessary for the features you request. External services must provide the data protection safeguards required by applicable law. Apple, Google, and the apps you choose operate under their respective policies; using those services does not give ElxDeveloper the ability to delete or control data they receive independently.

These providers may process information outside your country of residence or the European Economic Area. Their policies describe the destinations, conditions, and safeguards applicable to their processing and transfers.

6. Emergency calling feature

The emergency feature initiates a call using your device's telephone system. The app does not automatically attach or send coordinates, photographs, or saved places to the emergency service.

The call itself, and any information processed independently by the operating system, mobile network operator, or emergency service, are subject to their terms and applicable law. This policy does not imply that a telephone call has no associated data.

7. One-time payment

The app offers additional features through a one-time payment. Payments made through the App Store are handled by Apple under its terms and privacy policy. ElxDeveloper does not receive your full payment card number or payment credentials. The app uses the information needed to recognise your entitlement to purchased features.

8. Legal bases

Where the General Data Protection Regulation applies, processing necessary to provide the features you request is based on performance of the service relationship under Article 6(1)(b). Access to resources requiring authorisation takes place with system permission and, where legally required, your consent under Article 6(1)(a). You may withdraw that consent without affecting the lawfulness of processing carried out before withdrawal.

Contact information you provide when requesting support is used to address your request within that relationship. Compliance with legal obligations, including responding to data protection rights requests, is based on Article 6(1)(c) where applicable.

9. Retention and deletion

Saved places and associated photographs remain in the app's storage until you delete them or the local app data is erased. You can edit and delete places using the app's management options. ElxDeveloper does not hold its own remote copy of this content and cannot recover or delete it remotely.

Original images in your photo library, exported files, backups, and previously shared content are retained independently. If you also wish to delete them, you must do so in the relevant photo library, storage location, or service. Restoring a backup may reintroduce data contained in an earlier copy.

Support communications are retained for the time necessary to resolve the enquiry and meet any applicable responsibilities or legal obligations; they are then deleted when no longer needed. External services apply their own retention periods.

10. Security

Local content benefits from iOS protection mechanisms and the security configured on your device. Protect access with a passcode and, if you choose, the available biometric mechanisms. Keep your operating system up to date and store backups in a protected location.

Absolute security cannot be guaranteed, and this policy does not claim that exported files are encrypted by the app. Locations and photographs can reveal private information: share them only with people and services you trust.

11. Your rights and enquiries

Where applicable, you may request access, rectification, erasure, restriction of processing, objection, and portability of your data, and withdraw consent, by contacting elxdeveloper@gmail.com. Requests will be handled within the legal time limits, generally within one month, subject to any extensions allowed by law.

For data that exists only on your device, control is exercised through the app's features and system settings. ElxDeveloper does not need to receive your locations or photographs to explain how to manage them. For information processed independently by Apple, Google, or another provider, you can use their respective privacy controls and request procedures.

If you believe your rights have not been respected, you may lodge a complaint with the competent data protection supervisory authority. In Spain, you may contact the Spanish Data Protection Agency (Agencia Española de Protección de Datos, AEPD).

12. Changes to this policy

This policy may be updated to reflect changes to features, services used, or applicable law. The latest update date will appear at the top. If a change requires additional information or new consent, it will be provided or requested before the relevant processing takes place.
